50's superstar Chubby Checker has prevailed in his effort to stop the distribution of an X-rated phone app bearing his name.
Chubby got himself in a "twist" when a company began selling an app called "The Chubby Checker" -- with promises that it could determine the size of a man's package without any peeking.
The singer, whose real name is Ernest Evans, filed suit against Hewlett Packard and its Palm subsidiary, claiming the title violated his trademark protection and damaged his reputation.
In a settlement that was filed earlier this week, HP agreed not to make use of the singer's stage name or likeness, but admitted no liability. Chubby's claims of unfair competition and right of publicity were denied, but the end result is the same -- there's just one Chubby Checker out there.
